The short version

We collect what you give us and what a website unavoidably sees. Nothing more.
We record and transcribe our calls, and we use AI systems to analyse them. That is how the work gets done, and we would rather tell you than have you find out.
We do not sell your information. Not to anyone, for any price, ever.
Everything we build for you lives in your own account, under your name and your card. That data was never ours to hold.
You can ask us for a copy of what we have, or ask us to delete it, at any time. Write to [email protected] and we will answer within 30 days.

Who we are

PitchBlack is a trade name used by Daniel Kahn, an individual operating in the State of Oklahoma. PitchBlack is not a separate legal entity. When this policy says "we" or "us", it means Daniel Kahn doing business as PitchBlack, together with the AI systems he builds and directs to carry out the work.

This policy covers the website at ptchblck.org and everything that happens when you book or take a call with us, become a client, or write to us.

What we collect

Things you give us

Your name, email address, phone number, and whatever you choose to tell us in a booking form, an email, or on a call. When you book, we ask only for what is needed to hold the appointment and reach you about it.

Things a website sees

Your IP address, browser type, device type, and the pages you visit. Any website receives this simply by being loaded. Two specific outside requests happen when a page loads, and both receive your IP address as a consequence of doing their job:

Google Fonts serves the typefaces this site is set in.
Google reCAPTCHA protects the booking form from automated abuse.

Booking and appointment records

The time you chose, the contact details you gave, any notes attached to the appointment, and whether the appointment happened.

Client records

If you become a client: our correspondence, the notes and analysis we produce from our calls, quotes, invoices, and the record of what we built and when.

Payment information

Handled entirely by Stripe. We see the fact of a payment, the amount, and the date. We never see or store your full card number.

Calls, recordings and AI

This section describes something most firms leave out. We would rather be direct about it.

We record and transcribe our calls with you. Discovery calls, solutions calls, and monthly review calls. You will be told this when you book, again in your confirmation, and again at the start of the call itself. If you would prefer not to be recorded, say so and we will not record.

We analyse those recordings and transcripts using AI systems. This is not incidental. It is a core part of how the service works: we go over what you said, what you did not say, and what could be built, and the AI systems we direct are how that analysis gets done thoroughly rather than from memory.

What that means in practice is that the contents of your call, including information about your business, are processed by third party AI providers acting on our instructions.

We do not sell your information. We do not use it for advertising. We use AI providers under business terms that do not permit training on customer content. Your call is used to serve you, and for nothing else.

How we use it

To hold, confirm, and remind you about appointments.
To understand your problem and design something that solves it.
To produce quotes, invoices, and the systems you commission.
To answer you when you write to us.
To keep records the law requires us to keep.
To tell you about our own services, if you have asked us to, and only until you ask us to stop.

Where the law requires a legal basis for processing, ours is the performance of a contract with you, our legitimate interest in running and improving the service, your consent where consent is required, and compliance with legal obligations.

Who else touches it

We use a small number of outside providers to run the business. They act on our instructions and may not use your information for their own purposes. We are naming them because a policy that will not say who holds your data is not worth reading.

We will also disclose information if the law genuinely requires it, or to establish or defend a legal claim. If PitchBlack is ever sold or transferred, your information may transfer with it, and you would be told before that happened.

We do not sell your personal information, and we do not share it for cross context behavioural advertising.

Cookies and tracking

This site uses cookies and similar technologies that are necessary for it to function, including keeping your session and protecting forms from abuse.

We may also use analytics, advertising, and measurement technologies, including cookies and similar pixels from providers such as Google and Meta, to understand how the site is used and to measure advertising. Where we use technologies that require your consent in the place you are, we will obtain that consent before they run.

You can refuse or delete cookies in your browser settings. Necessary cookies cannot be switched off without breaking parts of the site.

Definite periods, rather than a vague promise to keep things only as long as necessary.

Invoices are the one long tail, and only because tax law requires it. We would keep them for less if we could.

The data inside what we build for you

Everything we build sits inside your own account, opened in your name and paid for on your card. Your contacts, conversations, and operational records live there, and they were never in our custody. When our work together ends, we do not delete your data, because we cannot. We simply lose access to it, and you keep all of it.

Anything above can be deleted sooner if you ask. See the next section.

Your rights

Some of these rights exist by law only in certain states and countries. We are offering all of them to everyone, because splitting people into tiers based on where they live is not how we want to run this.

Know what we hold about you and why.
Get a copy of it in a readable format.
Correct anything that is wrong.
Delete it, including call recordings and transcripts, subject only to records we are legally required to keep.
Opt out of any marketing message, immediately and permanently.
Object to processing, or ask us to restrict it.
Be treated the same whether or not you exercise any of this. We will never charge you more or serve you worse for asking.

To use any of these, write to [email protected]. We will respond within 30 days. We may need to confirm who you are first, so that we are not handing your information to somebody else.

If you are in the United Kingdom or the European Economic Area, you also have the right to complain to your local data protection authority. We would rather you came to us first, but the right is yours.

Security

We use reputable providers, we protect our accounts with multi factor authentication, and we limit access to what is needed to do the work. Because PitchBlack is one person and a set of systems, the number of people who can reach your information is very small, which is itself a meaningful protection.

We are not going to claim your data is perfectly safe, because nobody can honestly claim that. If a breach ever affected your information, we would tell you promptly and directly, and tell you what we knew even while we were still working out the rest.

Children

This is a service sold to businesses. It is not directed at anyone under 18 and we do not knowingly collect information from children. If you believe a child has given us information, write to us and we will delete it.

Changes to this policy

If we change this policy we will update the effective date at the top. If a change materially affects how we handle your information, we will tell current clients directly rather than relying on you to notice.
